1. The service
Memory on Repeat is a custom-song service operated by Everything & Beyond LLC. When you submit an intake form and complete payment, you ask us to create a personalized song using the details you provide. A song may include custom lyrics, vocal and musical production, and a digital audio delivery. We may use a combination of human creative direction, review, and technology-assisted production tools to provide the service.
2. Your order and timing
Standard service includes a minimum 48-hour quality-review window after verified payment. The 48-hour period is a minimum, not a guaranteed delivery deadline. If you select the separate two-hour express option, its target begins after verified payment and is subject to the song being ready for delivery. We will not knowingly promise a delivery time that we do not reasonably expect to meet.
If we cannot deliver within the time we represented, we will contact you with a revised date and a clear way to cancel for a prompt refund if you do not wish to wait. Please contact us promptly if an event date is critical.
3. Prices, payment, and promotions
Current prices and any applicable service fees are shown before you pay. Payments are processed by Stripe on its secure hosted checkout page. We do not receive or store your full payment-card number. Promotional codes are subject to their stated eligibility, redemption limits, expiration, and Stripe verification. A discount is not final until Stripe displays it before payment. Express delivery is not eligible for promotional codes unless we state otherwise in writing.
4. Changes, cancellation, and refunds
Because each song is made from personal details, please review the intake carefully before payment. Before production begins, contact us to request a correction or cancellation. Once paid production or substantial custom work has begun, a refund may be limited to situations where we cannot provide the purchased service, materially fail to follow the confirmed brief, or agree to a resolution in writing. This does not limit any non-waivable consumer rights that apply to you.
We will work in good faith on factual corrections, such as a misspelled name or an omitted detail that was clearly included in your submitted brief. We cannot guarantee that every subjective preference will be resolved by a revision, and we do not guarantee that a song will match a particular artist, recording, or copyrighted work.
5. Your content and permissions
You are responsible for the story, names, links, and other material you submit. You promise that you have permission to provide it and to ask us to use it for your custom song. Do not submit unlawful, threatening, defamatory, or infringing material. Do not provide private information about another person unless you have a lawful basis to share it for this purpose.
You keep ownership of the original personal details you provide. You give us a limited permission to use those details only to create, administer, support, and deliver your order, including storing the brief and working with service providers described in our Privacy Policy.
6. Finished song and use rights
After payment and delivery, you may enjoy, share, and use your delivered custom song for personal, non-commercial purposes. Any broader commercial use, paid advertising, resale, distribution through music platforms, synchronization, trademark use, or claim of exclusive copyright ownership requires prior written permission from Everything & Beyond LLC. We retain rights in our service, production process, templates, branding, and any underlying materials that are not your submitted personal details.
We will not use your story, name, image, voice, or finished song in public marketing without separate permission from you. We may keep internal operational records and a private copy necessary to provide support, resolve disputes, comply with law, or improve service as described in the Privacy Policy.
7. Artist references and prohibited requests
You may describe a genre, mood, era, instrument, or general musical qualities. Do not ask us to copy a living or deceased artist’s distinctive voice, reproduce protected lyrics, or make a song that is confusingly similar to a specific copyrighted recording. We may decline or modify a request that creates legal, safety, technical, or quality concerns.
8. Communications
By submitting an order, you agree that we may send transactional messages about your intake, payment, delivery, and service updates. If you provide separate marketing consent, we may also send future Memory on Repeat news or offers. You can unsubscribe from optional marketing or payment-recovery messages using the link in those emails. Transactional messages necessary to complete or support an active order may still be sent.
9. Disclaimers and limits
We provide the service with reasonable care, but creative output is subjective and may depend on the accuracy and completeness of your brief. To the maximum extent allowed by law, the service is provided without warranties beyond those expressly stated in these Terms. Our total liability for a claim relating to an order is limited to the amount you paid for that order, except where applicable law does not permit that limitation.
10. Governing law and updates
These Terms are governed by the laws of Wyoming, without regard to conflict-of-law rules, except where your local consumer-protection law requires otherwise. We may update these Terms for future orders. The effective date above shows when this version began. Material changes will apply prospectively unless law requires another approach.
